CAPE TOWN - Ajax Cape Town have been left with no choice but to continue their legal battle for justice with regard to the Tendai Ndoro saga.
With the PSL’s decision to appeal Judge Denise Fisher’s High Court ruling, which overturned arbitrator William Mokhari’s verdict, the Cape club has been at pains to try and find an amicable solution, a compromise, that benefits all the stakeholders.
According to Ajax chief executive Ari Efstathiou, they have found every door closed. Even Judge Fischer, in delivering her judgement earlier this month, suggested that, in the public interest, all parties get together to try and hammer out a favourable solution.
Efstathiou said on Tuesday that he has spoken to the PSL chairman (Irvin Khoza), he waited two hours in reception at the PSL’s executive committee without getting an audience, and he spoke at the board of governors meeting, and still there has been no desire from anybody in the PSL to sit down around a table and thrash out the issue.
As a result, Ajax have no choice but to, as Efstathiou put it, “throw everything at it”.
The Cape club’s next moves include:
(1) to launch an application to interdict the start of the 2018-19 PSL season (it is scheduled to start on August 4);
(2) they will be opposing the PSL’s application for leave to appeal Judge Fischer’s verdict;
(3) and, if the PSL is granted the right to appeal, they will apply for the Judge’s ruling to stand until the process is complete.
Efstathiou said he and his legal team will be finalising their papers on Tuesday and will lodge their documentation with the South Gauteng High Court as soon as possible.
“We’ve done everything according to the rules,” Efstathiou said. “When the Dispute Resolution Chamber (DRC) said we could play Ndoro, we did. When we were then told we couldn’t play him, we didn’t.
“We’ve been vindicated by Judge Fischer’s ruling, but here we are still, six months down the line, and nowhere near to a solution.
“We have been eager to meet with all parties involved to try and find a way out of the impasse, but we have been rebuffed every time. Because of this, we have had no choice but to go the route we have now chosen.”
